Brand Calibration Terms of Use Agreement and Liability Disclaimer

Please accept these terms and conditions before proceeding.

Brand Calibration ™ and its videos, documents, and other associated content (hereinafter inclusively referred to as “Brand Calibration™”) have been produced by Carol Hampshire. When you purchase the Brand Calibration™, you agree to these Terms of Use and Liability Waiver.

All sales are final for the online Brand Calibration™. No refunds will be issued for Brand Calibration™once the sale is completed.

Access to the training materials after the 8-week period will be available for 1 year from the date of purchase.

Carol Hampshires program Brand Calibration™ is Copyrighted. By purchasing Brand Calibration™, Carol Hampshire grants you a nonexclusive, non transferable, revocable license to access and use Brand Calibration™’ and any associated materials solely for your own personal and non-commercial use. The copying, redistribution, use, or publication by you of any of the content within Carol Hampshires’ Brand Calibration™ is strictly prohibited. Your purchase of Brand Calibration™ does not grant you any ownership rights to Brand Calibration™. Any breach in terms of this agreement may result in termination of your access to Brand Calibration™ materials.

When you complete the purchase process, you will receive a password allowing you to access Brand Calibration™ content. You agree to maintain the confidentiality of your password and are fully responsible for all liability and damages resulting from your failure to maintain that confidentiality and all activities that occur through the use of your password. You agree to immediately notify us of any authorized use of your password or any other breach of security.

Part of the program materials includes access to customisable templates. You will be given access to the one-page website, and sales funnel template bundle in week 7 of the Brand Calibration™ program. These templates are developed for WordPress or Kajabi and can only be used on these platforms. They include installation but do not include domain hosting. Due to licensing constraints, these templates cannot be used on unlimited sites. Each purchase allows for a single WordPress or Kajabi installation.

Carol Hampshire does not warrant that the materials will be error free including technical inaccuracies, nor free of viruses or other harmful matter. The entire cost of any necessary service, repair, or correction, is the program participants’ responsibility.

Your use of these course materials is at your own risk, and any content that you download is downloaded at your own discretion and risk.

It is your own responsibility to keep your own equipment protected and any antivirus software up to date. You are solely responsible for any damage to your computer system and for any loss of data that results from the downloading of any content, including any damages resulting from computer viruses.

By enrolling in a Brand Calibration™ Payment Plan, I agree to the following terms and conditions:

• I am responsible for paying each of the agreed installments on time bi-weekly or as scheduled by the portal
• Failure to make a payment by the due date will result in removal from the Brand Calibration™ Hub, and your profile will be reinstalled once the payment has been reflected.
• Should it become necessary for Carol Hampshire to take legal action or use a collection agency to secure payment of any amount due, I will be responsible for all collection costs and legal fees.

In no event will Carol Hampshire or Carol Hampshires employees, contractors, vendors, affiliates or agents be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages arising from your use or misuse of this course whether such damages arise in contract, tort, negligence, equity, statute or by way of any other legal theory regardless of whether such damages could have been foreseen. Notwithstanding anything to the contrary contained herein, Carol Hampshire’s liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to her for the video(s) she provides before the event giving rise to liability.

This Terms of Service Agreement shall be governed and construed by South African law. Any cause of action by you with respect to Carol Hampshires’ Website or Content must be instituted within one (1) year after the cause of action arose or be forever waived and barred. Should any part of this Agreement be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect.

To the extent that any Content is in conflict or inconsistent with this Agreement, this Agreement shall take precedence. Carol Hampshire’s failure to enforce any provision of this Agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision. Carol Hampshire’s rights under this Agreement shall survive any termination of this Agreement.

Terms of website use

This website is owned by Carol Hampshire. Use of this website is at your own risk. We host our site on a reputable platform and take reasonable efforts to maintain and host the site. However, we make no explicit representations or warranties as to the safety or your individual use of the website. The Terms and Conditions contained on this page is subject to change at any time.

Intellectual Property Notice

All images, texts, graphics, website copy, and trademarks are the property of Carol Hampshire, unless another party is attributed.

By accessing this website you agree that:

• You will not copy, duplicate or steal our website or it’s content. This is considered theft, and we reserve our right to prosecute theft to the full extent of the law.
• You will not copy design ideas, brand phrases, or anything similar. This is considered theft.
• You will not copy, adapt, or imply that this website or it’s content, designs, templates are yours or created by you.

Template Shop

By purchasing a template from this website, you are legally bound to the following terms.

The images that are in the templates are for display purposes only and need to be replaced with your own images.

You may not resell, redistribute or  pass off the template(s) as your own.

Graphic designers, website designers, funnel designers, brand designers etc, are prohibited from claiming the templates as their own, reselling them or promoting them as original, unique work.

You cannot use them as inspiration for your own client projects and you cannot use them as your own, to advertise your services.

Template bundles will remain the property of Carol Hampshire until paid in full.
